Waqf (Endowment) of the Righteous Caliph Omar Ibn Al-Khattab (MABPWH): Its Position and Impact on Jurisprudence and Tracing

Abstract

Charity endowment is one of the most important jurisprudential doors because of its proven developmental role in our ancient Islamic civilization and its expected role in the present and the future. The jurisprudential tradition has embraced many practical applications of the endowment, but the most important of these is the endowment of the Righteous Caliph Omar Ibn Al-Khattab, may Allah be pleased with him (MABPWH). This research aims to highlight such endowment as a model for the jurisprudence at the beginning of Islam; to show the path of righteousness lit by such noble people, trace their trail, and achieve scientific authenticity in Sharia jurisprudence. The study concludes with the following important results: (1) the endowment of Omar Ibn Al-Khattab, (MABPWH)  is significantly more blessed because the advisor in that endowment was the Messenger, may Allah bless him and grant him peace, (2) the first endowment document in Islam is the document of Omar, (MABPWH)  and (3) the diversity of the properties  endowed from Omar gave a broader scope for jurisprudential deduction, and the impact of this endowment reflected in stimulating this foundation. The research recommends the commissioning of future studies of this blessed endowment of the righteous Caliph Omar Ibn Al-Khattab, (MABPWH)  as the legislative origin of endowment, highlighting jurisprudential rulings through it, and benefiting from it in the contemporary endowment documents.
