Uncommon Harms of Neighborhood in Jordanian Civil Law: Comparative Study

Abstract

The study dealt with the issue of the unfamiliar harms of the neighborhood through a comparative study. The study's methodology is represented in three basic approaches: the descriptive approach, Analytical Approach, and Comparative Approach to comparison between the texts of the Jordanian Civil Law and the texts of the Algerian Civil Law. The most important results of study are that the best criterion that should be relied upon in determining civil liability for the harms of neighbors is the objective, not subjective, criterion, which is an application of the theory of abuse of right. In light of these results, we conclude the needed to introduce some changes to the texts of Articles (1027) and (24) bis to keep pace with developments and changes that affect the neighborhood relationship.
